The Social Security Fairness Act, signed into law on January 5, 2025, repealed the Windfall Elimination
Provision (WEP) and the Government Pension Offset (GPO). Although WEP and GPO primarily affect
retirement and spousal/survivor benefits, this change is also relevant to SSDI in situations with
overlapping benefits or benefit transitions. The repeal is retroactive, and affected individuals began
receiving retroactive “catch-up” payments in early 2025.
